1. Acceptance of these terms
By accessing or using MedicareZulu, you agree to these Terms of Service and to any additional agreement that applies to your account, agency, subscription, or use of the service. If you are using MedicareZulu for an organization, you represent that you are authorized to use the service on that organization’s behalf.
2. The MedicareZulu service
MedicareZulu provides software tools intended to help authorized users research Medicare plan information, organize client information, maintain agency and carrier settings, and perform related insurance-workflow tasks.
MedicareZulu is a private software platform. It is not Medicare.gov, is not the federal Medicare program, is not a government agency, and does not itself provide Medicare benefits.
3. Accounts and authorized use
You are responsible for maintaining the confidentiality of your login credentials and for activity performed through your account. You must provide accurate account information and promptly protect or update credentials if you believe an account has been compromised.
Organizations are responsible for controlling which users receive access, assigning appropriate permissions, and removing access when it is no longer authorized.
4. Client information and lawful access
You may enter, import, view, or manage personal, financial, Medicare, Medicaid, health-related, provider, medication, or other client information only when you are authorized to do so. You are responsible for obtaining any consent, authorization, license, appointment, or other permission required for your use of that information.
You are also responsible for complying with laws, regulations, carrier requirements, agency policies, record-retention rules, and contractual obligations that apply to your business and to the information you place in MedicareZulu.
5. Medicare plan information
Plan benefits, premiums, service areas, formularies, provider participation, enrollment availability, commissions, documents, and other plan information can change. MedicareZulu may compile information from public datasets, carrier materials, user configuration, or other sources.
Users must verify material plan details and enrollment eligibility against the applicable current carrier materials, official plan documents, Medicare sources, and other authoritative information before advising a consumer or completing an enrollment. MedicareZulu does not guarantee that third-party plan information will always be complete, current, or error-free.
6. Prohibited use
You may not use MedicareZulu to violate law; access information without authorization; misrepresent your identity, license, appointment, or authority; interfere with the service; attempt to bypass access controls; introduce malicious code; scrape or extract data in a manner that harms the service; or use another person’s credentials without permission.
You may not use MedicareZulu to make unlawful, deceptive, discriminatory, abusive, or fraudulent communications or transactions.
7. Third-party services and links
MedicareZulu may link to or interoperate with carriers, enrollment platforms, document hosts, communications providers, data providers, or other third-party services. Those services are governed by their own terms, privacy policies, availability, and security practices. MedicareZulu is not responsible for third-party services that it does not control.
8. Availability, maintenance, and changes
We may update, modify, suspend, or discontinue features when reasonably necessary to maintain, secure, improve, or operate the service. We do not promise uninterrupted or error-free operation, and temporary outages may occur for maintenance, infrastructure problems, security events, or circumstances outside our control.
9. Disclaimers
To the maximum extent permitted by law, MedicareZulu is provided on an “as is” and “as available” basis. We disclaim warranties that are not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
MedicareZulu is a software tool and does not replace professional judgment, carrier guidance, official Medicare materials, legal advice, compliance advice, tax advice, or any licensing or certification requirement.
10. Limitation of liability
To the maximum extent permitted by law, MedicareZulu and its owners, operators, affiliates, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, lost data, or loss of goodwill arising from use of or inability to use the service.
Any limitation stated in a separate signed agreement governing your account will control to the extent it conflicts with this section.
11. Suspension and termination
Access may be suspended or terminated for nonpayment, security risk, unlawful use, material breach of these terms, misuse of client information, or conduct that threatens MedicareZulu, its users, or third parties. Account-specific agreements may provide additional termination rights or procedures.
12. Changes to these terms
We may update these Terms of Service as the service or applicable requirements change. Updated terms will be posted with a revised effective date. Continued use after updated terms become effective constitutes acceptance to the extent permitted by law.
13. General terms
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision does not waive the right to enforce it later. A separate signed agreement may supplement or supersede portions of these Terms for a particular customer or agency.
